General Terms and Conditions:
- Area of application
These terms and conditions apply to the commercial rental of electric bicycles of any kind (hereinafter: vehicle). - Obligations of the landlord
1. usability of the vehicle: The Rental Firm shall provide the Hirer with a roadworthy vehicle. The Hirer shall check the roadworthiness of the vehicle before accepting it.
2. repair: If a repair becomes necessary during the rental period for which the Hirer is not responsible and in order to ensure the operation or road safety of the vehicle, the Hirer must return the vehicle to the Rental Firm during business hours. If the tenant wishes to visit a workshop himself, this is only possible with the prior consent of the landlord; otherwise the tenant shall bear the costs of the assignment himself. - Obligations of the tenant
1. the tenant’s liability also extends to damage costs such as expert costs or depreciation. The hirer uses the vehicles at his own risk. The renter must check the condition of the vehicle independently.
2. the Hirer must handle the vehicle with care and within the scope of normal use for such vehicles and observe all relevant regulations and technical rules for use in order to avoid damage. Costs for repair work not caused by wear and tear shall be borne by the tenant. The Rental Firm shall be entitled to terminate the contractual relationship prematurely at any time in the event of improper use of the vehicle and to demand the return of the vehicle, without the obligation of the Hirer arising from Clause 1. III. 1. for the period during which use was not granted.
3. the vehicle must be properly locked and securely stored.
4. in the event of loss for which the Hirer is responsible, the Hirer must pay EUR 1600 per vehicle. In the event of theft, the renter must file a theft report with the local police. The documents relating to the theft report will be made available to the landlord. The renter shall be liable for any damage to the vehicle caused by the renter.
5. the tenant has – without prejudice to para. II. 2., III. 6. to notify the Rental Firm immediately of any defects or damage to the vehicle. If no such notification is made, the hirer shall be liable for all further costs arising from the failure to notify, in particular personal injury and property damage to third parties.
6. in the event of an accident, the Hirer must inform the Rental Firm immediately, at the latest upon return of the vehicle, of all details – if necessary in writing, including a sketch. In particular, the accident report must contain the names and addresses of the persons involved and any witnesses and, if applicable, the registration numbers of any vehicles involved. After an accident, the tenant must inform the police if the information required to clarify the accident cannot be reliably obtained by other means, e.g. with the help of witnesses. [Opposing claims may not be recognized. Damage caused by theft must be reported immediately by the tenant to the landlord and the responsible police authority].
7. if the rented bike is passed on to a third party, the renter assumes full responsibility for any damage caused to the rented bike by third parties. - Liability of the landlord
Apart from the breach of material contractual obligations, the Lessor shall only be liable for gross negligence (i.e. for intent and gross negligence). - Liability of the tenant
The tenant shall be liable – notwithstanding para. III. 6 – according to general liability rules if he damages the vehicle or commits any other breach of contract. In particular, the Hirer must return the vehicle in the same condition in which it was received. - Statute of limitations
A limitation period of six months shall apply to claims for compensation by the Rental Firm due to alteration or deterioration of a vehicle, unless the Hirer has caused an alteration or deterioration, in particular in accordance with Clause. III. 5. was concealed. - Age requirement
Vehicles may only be rented to persons of legal age; young people aged 16 to 18 may only rent a vehicle with the consent of a parent or guardian. Young people under the age of 16 must be accompanied by an adult. - Place of jurisdiction
The place of jurisdiction for both parties is Reutte. - Rates and rental times
The rental of e-bikes is free of charge
